This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully. Your privacy is important to us. This notice also describes your rights regarding your protected health information (PHI).
How We May Use and Disclose Health Information About You During the Course of Mental Health Treatment
For Treatment: We may use or disclose health information about you for the purpose of providing, coordinating, or managing your health care treatment, and related services. This includes consultation with clinical supervisors or other treatment team members. We would disclose PHI to any other consultant not directly involved in your immediate treatment plan only with your specific written authorization. By signing our consent for treatment, you acknowledge and agree to these uses and disclosures related to your direct care.
For Payment: We may use or disclose PHI so that the services you receive are billed to and payment is collected from you, your funders, or other interested parties. This includes collection agencies if your account becomes delinquent and you do not respond to our requests to resolve your account. Your consent will be obtained when services begin and that consent will remain in effect for as long as you receive services from us. Examples of payment-related activities are: making a determination of eligibility or coverage for insurance benefits, processing claims with our insurance company, reviewing services provided to you to determine medical necessity, or undertaking utilization review activities.
For Health Care Operations: We can use and share your PHI to run our practice, improve your care, and contact you when necessary. For example, we use health information about you to manage your treatment and services. We may share your PHI with third parties that perform various business activities (e.g., billing, typing, attorney, or accounting services) provided we have a written contract with the business that requires it to safeguard the privacy of your PHI.
Electronic Health Records & Telehealth: Your protected health information is stored securely within our electronic health record system. When providing services via telehealth, we use secure, encrypted platforms to ensure the privacy and confidentiality of your sessions and data.
Required by Law: Under the law, we must disclose your PHI to you upon your request. In addition, we make disclosures to the Secretary of the Department of Health and Human Services for the purpose of investigating or determining our compliance with the requirements of the Privacy Rule. Also, we will disclose your PHI about you when required to do so by Federal, State, or Local law.
Without Authorization:
We may also use or disclose your PHI in the following situations without your specific consent or authorization. These situations include:
Victims of Abuse, Neglect, or Domestic Violence: We may disclose PHI to a government authority authorized by law to receive reports of abuse, neglect or domestic violence, if we believe you are a victim of abuse, neglect, or domestic violence. This will occur to the extent the disclosure is: A) required by law; B) authorized by law; or C) agreed to by you and we believe the disclosure is necessary to prevent serious harm to you or other potential victims, or, if you are incapacitated and certain other conditions are met, a law enforcement or other public official represents that immediate enforcement activity depends on the disclosure.
To Avert a Serious Threat to Health or Safety: We may use and disclose your PHI to prevent a serious threat to your health and safety or the health and safety of the public or another person. If information is disclosed to prevent or lessen a serious threat, it will be disclosed to a person or persons reasonably able to prevent or lessen the threat, including the target of the threat. We would do this only to help prevent the threat.
Individuals Involved in Your Care or Payment for Your Care: Unless you object, or if we have your verbal permission, we may disclose health information about you to certain family members or close friends who are directly involved in your care. Such information will be directly relevant to that person’s involvement in your care. We may also give information to someone who helps pay for your care. In addition, we may disclose health information about you to an entity assisting in a disaster relief effort so that your family can be notified about your condition, status, and location. We may also disclose information to the person(s) that you have given legal authority to handle your estate after your death. If there is a family member that you do not want to receive information about you, please notify us.
Medical Emergencies: We may use or disclose your PHI in a medical emergency situation, to medical personnel only, in order to prevent serious harm. Our staff will try to provide you a copy of this notice as soon as reasonably practicable after the resolution of the emergency if you have not already received the Notice of Privacy Practices.
Public Health: Federal and State law may require or permit us to disclose certain health information related to public health risk. We may disclose PHI about you for public health purposes including: prevention or control of disease; injury or disability; reporting deaths; notifying a person who may have been exposed to a disease or may be at risk for contracting or spreading a disease.
Deceased Patients: We may disclose PHI regarding deceased patients as mandated by state law, or to a family member or friend who was involved in your care or payment for care prior to your death, in accordance with your prior expressed wishes or consent obtained during your lifetime, or as otherwise permitted by law.
Judicial and Administrative Proceeding: We may disclose your PHI pursuant to a subpoena (with your consent), court order, administrative order, or similar process.
Law Enforcement: We may disclose your PHI to a law enforcement official as required by law, for the following purposes: A) In compliance with a subpoena (with consent), court order, warrant, summons or similar process for the purpose to identify or locate a suspect, fugitive, material witness, or missing person; B) About you, the victim of a crime if, under certain limited circumstances, we are unable to obtain your agreement; C) About a death we believe may be the result of criminal conduct; D) In connection with a crime on the premises; E) In emergency circumstances to report a crime, the location of the crime or victims, or the identity, description, or location of the person who committed the crime.
Correctional Institution: Should you be an inmate at a correctional institution, we may disclose to the institution or its agents PHI necessary for your health and the health and safety of others.
Health Oversight: If required, we may disclose PHI to a health oversight agency for activities authorized by law, such as audits, investigations, and inspections. Oversight agencies seeking this information include government agencies and organizations that provide financial assistance to the program (such as third-party payers based on your prior consent), peer review organizations performing utilization and quality control, and compliance with civil rights laws.
Specialized Government Requests: We may use or share PHI about you for special government functions such as military, national security, and presidential protective services.
Workers Compensation: We may disclose your PHI for worker’s compensation or similar programs. These programs provide benefits for work-related injuries or illness.
With Authorization:
Other uses and disclosures not specifically permitted by applicable law will be made only with your written authorization, which may be revoked at any time, except to the extent that we have already made a use or disclosure based upon your authorization.
YOUR RIGHTS REGARDING HEALTH INFORMATION ABOUT YOU
You have the following rights regarding the protected health information we maintain about you:
Right to Inspect and Copy: You have the right to inspect and obtain a copy of your health information that may be used to make decisions about your care, with certain exceptions. We may charge a reasonable, cost-based fee for copies.
Right to Amend: If you feel that health information we have about you is incorrect or incomplete, you may ask us to amend the information. We may deny your request for an amendment, but we will notify you of the reason for the denial.
Right to an Accounting of Disclosures: You have the right to request an "accounting of disclosures." This is a list of certain disclosures we have made of your health information for purposes other than treatment, payment, or healthcare operations.
Right to Request Restrictions: You have the right to request a restriction or limitation on the health information we use or disclose about you for treatment, payment, or health care operations. You also have the right to request a limit on the health information we disclose about you to someone who is involved in your care or the payment for your care, like a family member or friend. We are not required to agree to your request, except for disclosures to a health plan for services for which you have paid out-of-pocket in full. If we do agree, we will comply with your request unless the information is needed to provide emergency treatment.
Right to Request Confidential Communications: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. For example, you can ask that we only contact you at work or by mail. We will not ask you the reason for your request and will accommodate all reasonable requests.
Right to a Paper Copy of This Notice: You have the right to a paper copy of this notice. You may ask us to give you a copy of this notice at any time. Even if you have agreed to receive this notice electronically, you are still entitled to a paper copy of this notice.
Right to be Notified of a Breach: You have the right to be notified in the event of a breach of your unsecured protected health information.
COMPLAINTS
If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the Department of Health and Human Services. To file a complaint with us, please Contact Us. All complaints must be submitted in writing. You will not be penalized for filing a complaint.
Important Note Regarding Iowa State Law: Please be aware that Iowa state law may offer additional protections for certain types of health information, particularly regarding mental health records. We will always comply with the more stringent privacy requirements, whether federal or state, to ensure the highest level of protection for your information.

Nature of Services: Blue Tree Counseling & Consultation provides professional mental health counseling services, including individual therapy, couples therapy, family therapy, play therapy, art therapy, forensic assessments, psychosexual assessments, and various consultation, training, and workshop offerings. Our services are provided by licensed professionals in accordance with ethical guidelines and applicable state and federal laws.
Client-Provider Relationship: Your engagement in our counseling or consultation services establishes a professional therapeutic relationship. This relationship is governed by ethical codes of conduct for mental health professionals and is distinct from other interactions on this website.
Confidentiality and Privacy: All client information is handled with the utmost confidentiality. Your Protected Health Information (PHI) is governed by our comprehensive Notice of Privacy Practices, which is available on our website and provided to you at the outset of services.
Payment for Services: Fees for counseling and consultation services will be discussed and agreed upon prior to the commencement of services. You are responsible for timely payment for services rendered. Information regarding insurance billing, co-pays, and payment plans will be provided separately.
Cancellation and No-Show Policy for Services: Appointments for counseling and consultation services require advance notice for cancellation or rescheduling to avoid charges. Our specific cancellation and no-show policy will be provided to you at the time of intake and is also available on our website.
Telehealth Services: If services are provided via telehealth, you agree to ensure a private and secure environment for your sessions. We utilize secure, encrypted platforms for telehealth. You understand that there are inherent risks to electronic communication, and we will discuss these with you. Telehealth services may be subject to geographical limitations based on therapist licensure.

MERCHANDISE RETURN POLICY Updated Effective Date: July 1, 2025
At Blue Tree, we want you to be completely satisfied with your merchandise purchases. If for any reason an item isn't quite right, here's how our return process works:
General Returns (Buyer's Remorse):
You may initiate a return for most items within 30 days of delivery.
The product must be in new or unused condition, with all original product inserts and accessories included.
For returns due to "buyer's remorse" (e.g., item didn’t fit, didn’t like the color/quality, changed your mind, ordered by mistake, bought it somewhere else), shipping costs for the return will be the responsibility of the customer.
Please ship the product as soon as possible so it arrives at our facility within 45 days of your receipt of the item.
Defective or Incorrect Items (Our Error):
If there are mistakes with your order, or if products arrive defective or damaged at the time of receipt, we are committed to making it right.
In such cases, we will resolve the issue by:
Sending you replacement parts or accessories,
Replacing the product entirely, or
Issuing a full refund for the cost of the merchandise and original shipping charges.
We will also cover the cost of any return shipping for defective or incorrect items.
